Cancellation Policy:In case of inclement weather, or unforeseen circumstances. a gift certificate may be issued to allow passengers to join Sunset Kidd on a more appropriate sailing day. All cancellations are up to the discretion of the office manager. Minimum passenger load: Sunset Kidd offers cruises all year long, with numerous cruises offered on any given day. On each and any of these cruises Sunset Kidd requires four (4) passengers (This is the break-even point related to the cost of taking the boat out sailing). As we get into off season or mid-week, some of these bookings will fall short of this minimum. If this happens on your cruise, then at the hour of schedule departure... you can choose to pay the minimum amount (4 passenger rate) and enjoy the SUPER-LOW PRICE of what equals a PRIVATE CHARTER. Or receive a certificate to come out sailing with us on another day. Corkage Fees: Sunset Kidd offers a fully stocked cocktail bar. No outside drinks / coolers are permitted onboard. Yes, Outside Food or appetizers are encouraged and permitted. Yes Special (outside) wines or Champagnes are permitted with a $15 corkage fee per bottle. (Outside Beer, rum, Tequila etc are never permitted) Sunset Kidd has been offering Sailing Cruises along the Santa Barbara Coastline since 1987. In that time, we can account for only one twisted ankle. No injuries have ever occurred that required professional medical attention or emergency assistance. Sunset Kidd's cruises are offered upon a Coast Guard Certified Passenger Vessel. Upon numerous annual safety inspections, the crew of the Sunset Kidd have been officially recognized by the U.S. Coast Guard for meeting all standards with zero definicies! It is with great pride that we enter our third decade of offering sailing cruises along the Santa Barbara coastline. Release of Liability: ACKNOWLEDGEMENT AND ACCEPTANCE OF RISKS: I, the undersigned, hereby acknowledge that I have voluntarily chosen to take part in Sunset Kidd's Sailing Excursion. I herby understand that certain risks are inherent in any such adventure activity and cannot be fully eliminated, precluded, or controlled. I appreciate that these risks, some of which can contribute to the unique character and enjoyment of the activity, can also be the cause of injury, illness and death. I know and fully understand that a sailing excursion on any type of sailing vessel, as well as all associated activities such as but not limited to swimming, snorkeling and fishing, are outdoor adventure activities in an aquatic environment. The Pacific Ocean is still deemed a wild frontier with inherent risks and hazards where serious accidents can occur, participants can die, sustain injuries, become ill and damage to property may arise. These risks and hazards include, but are not limited to, (1) loss of control of the sailing vessel, falls overboard, slips or falls at any time while boarding, deboarding, or on-board, any injury or accident occurring while traveling in a dinghy/tender, collision with other vessels, docks, reefs, rocks and/or any other man-made or natural obstacles, whether obvious or not; (2) judgment, decision-making and professional conduct of the Captain (and/or First Mate, if one is present); (3) submersion in water, drowning, lung expansion or any other injuries associated with water sports and other water-related activities, including diving; (4) encounters with aquatic creatures, aquatic animals or other aquatic life. I hereby agree that Sunset Kidd Sailing Cruises may use film, voice, or photographic records of this sailing adventure trip for its promotional and/or commercial purposes. Upon the above terms, I understand the by the very nature, sporting activities like sailing involve an increased risk of personal injury. I agree to participate in this event and realize that I am personally responsible for my safety. That I will stay alert to the hazards of the sea and hereby waive, release and indemnify and hold harmless the Vessel and its owners, operators, and charterers, against and from any and all losses, damages, expenses (including attorney fees), claims, demands, causes of action or liabilities for personal injury, death, property or consequential damages of whatever kind and by whomever and wherever asserted arising out of, resulting from or related to my presence and/or activities on board or related to the Vessel and/or the Excursion Sail. I hereby expressly and voluntarily assume all risks in connection with said activities, whether foreseeable or unforeseeable. I further agree to indemnify the vessels and event organizers from all claims, demands, costs, or judgments arising out my own acts or omissions while participating in the above-referenced event. I further state that I am of lawful age and legally competent to agree to this affirmation and release; That this includes those in my party or family that I am paying their fare. that I understand the terms herein are contractual and not a mere recital; and that I hereby purchase said tickets on the conditions hereby provided. No tickets can be purchased without this agreement in place. If you do not agree to these terms, do not proceed with this transaction.
